Platform Agreement and Ticket Agreement

General

Set out below are the agreements governing the use of the website rebeltickets.es (including all of its subdomains intended for other countries, cities, regions, business divisions or languages), as well as its applications for various devices.

RB Tickets North SL (hereinafter, “Rebel Tickets”), with CIF B13682232, registered on 8 May 2023 in the Registro Mercantil de España, Tomo 6184, Folio 202, Sección 8, Hoja BI 80651, Anotación 1, with its registered office at Polígono Pinoa 2H, Zamudio (48170), Vizcaya, España, is the entity responsible for the platform.

Firstly, you will enter into a direct user agreement with Rebel Tickets, which governs everything relating to your account, your personal data and the technical aspects linked to the use of the platform. This agreement shall hereinafter be referred to as the “Platform Agreement”.

On the other hand, when you carry out a transaction through the platform, an agreement will be formalised between the buyer, the seller and Rebel Tickets. This agreement is referred to as the “Ticket Agreement”.

Both agreements (the Platform Agreement and the Ticket Agreement) shall be governed exclusively by Spanish law. Unless otherwise provided by mandatory law, any dispute arising from the interpretation, performance or validity of these agreements shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of the city of Bilbao, Spain.

Platform agreement

Applicability:

This Platform Agreement has been drawn up by RB Tickets North SL (which operates under the trade name “Rebel Tickets”), with its registered office at Polígono Industrial Pinoa - Nº 2, H (Zamudio) and with CIF B13682232. By using the Platform, you will enter into an agreement with Rebel Tickets (the “Platform Agreement”) in the capacity of “User”. The articles included under the heading “Ticket Agreement” shall not apply to Rebel Tickets. Rebel Tickets reserves the right to amend this Platform Agreement at any time. If you continue to use the Platform, you will automatically accept all changes made to this agreement.

Platform service:

By means of its online digital platform (the “Platform”), Rebel Tickets provides a service that facilitates the purchase and sale of all kinds of tickets, both electronic and physical, for a wide variety of venues and events, including but not limited to nightclubs, clubs, sporting events, concerts, parties, festivals, recreational activities and other cultural or entertainment events (the “Platform Service”).

Registration:

You may access the Platform Service once you have registered using a valid email address, or through a Google or Apple account. All personal data provided must be truthful and accurate. Each person may register only one account, and users who have previously been blocked from the Platform are prohibited from creating new accounts. Registration with Rebel Tickets is reserved exclusively for persons over 18 years of age. Rebel Tickets reserves the right to delete any account that breaches these conditions.

Privacy:

Rebel Tickets protects your personal data in accordance with the General Data Protection Regulation (“GDPR”) and the applicable legislation, where relevant. Rebel Tickets processes the personal information you provide in order to enable the use of the Platform Service and to communicate with you in this regard. You will find more information in the Privacy Policy on our website.

Rebel Tickets also uses Cloudflare Turnstile in various places on the platform to protect itself against automated or malicious actions. By using our services, you accept Cloudflare’s terms of service and privacy policy.

Personal use:

The Rebel Tickets Platform Service is designed exclusively for personal use. Misuse of the Platform by buyers or third parties for commercial purposes is discouraged and prohibited. The use of scripts, automated or semi-automated programs, and any other method that makes it possible to obtain an advantage or priority in the acquisition of tickets is strictly prohibited. The use of such practices may result in the temporary or permanent blocking of the User, as well as of the devices from which the connection to the Platform was made.

Search ranking:

On the platform, the ranking of ticket listings in search results is determined according to various factors, the most notable of which are the following:

Listings are ordered mainly from lowest to highest price. In addition, events may be ordered by date, as well as according to the number of tickets available, sold or wanted. Furthermore, certain events may on occasion be highlighted, such as those organised by partners or those that generate particular interest among users.

Where the Platform facilitates the primary sale of tickets through a ticket shop of the event or venue, the corresponding listing or link will be identified with a specific label to distinguish it from the listings published by private sellers.

Liability:

Rebel Tickets shall not be liable to the User for damage of any kind arising from the use of the Platform, except in cases where such liability is enforceable by law on the grounds of having acted with wilful misconduct or gross negligence.

Use of the Platform is at the User’s sole responsibility. Rebel Tickets does not guarantee the permanent availability or error-free operation of its systems, nor does it assume any obligation with regard to the content, accuracy or outcome of the operations carried out through the Platform.

Likewise, Rebel Tickets may, at any time and without the need for prior notice, interrupt, limit or suspend access to the Platform, in whole or in part, whenever it deems appropriate for operational, technical, legal or security reasons, without this giving rise to any right to compensation.

Payment service:

The payment processing associated with purchase and sale transactions carried out through the Platform may be managed by external providers engaged by Rebel Tickets, including Stripe. Where Stripe’s services are used, they will be subject to the Stripe Terms and Conditions of Service, acceptance of which is mandatory in order to operate as a Buyer or Seller on the Platform. By accepting this agreement and using the service, the User expressly consents to be bound by the terms applicable to the payment service provider and authorises Rebel Tickets to share with that provider the information necessary for the proper execution of payment transactions, including relevant personal and transactional data.

Abuse:

As a condition for the use of the Platform Service, you agree not to offer any information, data or content through the Platform that could infringe any law or regulation.

You further undertake that you:

  1. will not feign any inappropriate relationship with any person or entity;
  2. will not access restricted/protected areas of the Platform;
  3. will not forward any virus, worm, junk mail, spam, chain messages, unsolicited offers or advertising of any kind or for any purpose;
  4. will not probe, scan or test the vulnerability of the Platform or of any other related service or network, nor breach security and authentication*; and
  5. will not use scripts, (partially) automated programs or other methods to obtain priority in purchases.

If Rebel Tickets were to suspect that you are not complying with the Platform Agreement, you could be denied (temporarily or permanently) access to the Platform and to the Platform Service with immediate effect. In the event of a breach, we reserve the right to keep your (relevant) data and information in our records for future reference. This means that, in the event of a breach of the Platform Agreement, we will have legitimate grounds to retain your data and will not have to respond to your request to delete all of your data from our systems. We do this to prevent abuse in the future.

Disclosure of information:

Rebel Tickets shall at all times be entitled to disclose information in order to:

  1. Conduct its defence in legal proceedings,
  2. Comply with rulings or judgments issued by judicial authorities,
  3. Meet legal or regulatory obligations or requests from government bodies,
  4. Safeguard national security, defence, public order or public health,
  5. Protect and enforce its own rights and interests.

Complaints procedure:

If you have any complaint regarding the Platform or the Platform Service, Rebel Tickets wishes to be informed about it. Please send your complaint to us (with as full an explanation as possible) at support@rebeltickets.es.

Severability:

All clauses or provisions of this Platform Agreement must be interpreted independently, the remaining clauses not being affected in the event that one of them has been declared null and void by a court judgment or arbitral award that is final. The affected clause or clauses shall be replaced by another or others that preserve the effects pursued by this Platform Agreement.

Ticket agreement

Ticket agreement:

If you offer an e-ticket for sale on the Platform, or if you buy an e-ticket from another person, an agreement will be entered into between you (as User) and Rebel Tickets. The specific legal entity with which you formalise this Ticket Agreement will depend on the place where the event of the e-ticket in question is held. Rebel Tickets reserves the right to amend this Ticket Agreement. If you offer a (new) e-ticket for sale or for purchase and the Ticket Agreement has changed, you must accept the most recent version of this Ticket Agreement.

Purchase agreement:

A Purchase Agreement is entered into between the “Seller” and the “Buyer” of a ticket; this agreement is concluded when the “Buyer” makes a payment for a ticket of the “Seller”; however, the refund or the dispute (also called a “chargeback”) of the payment for the ticket does not under any circumstances terminate this agreement, and the obligations and rights of the “Buyer” and the “Seller” between themselves and with Rebel Tickets shall remain intact.

The ticket agreement shall be in force in the case of tickets in physical format as well as digital tickets, although for tickets in physical format, Rebel Tickets will not manage the payments or the exchange of tickets, and it will be the buyer and the seller of the ticket who must meet in order to carry out the exchange of that ticket.

Where users buy tickets directly in an official ticket shop through our Platform, such purchases shall be subject to the applicable general terms and conditions of the ticket shop in question.

EU consumer legislation:

European consumer protection rules apply only to relationships between a business and a consumer, and not to transactions carried out between private individuals. Since Rebel Tickets operates mainly as an intermediation platform between users, oriented towards personal use, such rules shall not apply to the Ticket Agreement entered into between Buyer and Seller.

In certain cases, Rebel Tickets may offer the option of acquiring tickets directly from official channels integrated into the Platform. However, even in these situations, the right of withdrawal provided for in European Union consumer legislation shall not apply, since tickets constitute services related to leisure activities that are performed on a specific date or within a specific period, which are expressly excluded from that right under the applicable rules.

Therefore, neither in transactions between private individuals nor in purchases made through official channels within the Platform will users have a period in which to revoke the purchase or request a refund due to a change of mind.

Creating ticket listings:

As a Seller, you may put an e-ticket up for sale on the Platform by uploading the corresponding file. That file must be the official medium provided by the event, without modifications or alterations. As a general rule, scans, screenshots or edited files of e-tickets will not be accepted. However, in those cases where the event organiser only offers this type of medium, Rebel Tickets may, at its discretion and without any obligation, accept such formats, provided that they are sharp and contain a valid scannable code (QR, barcode, etc.).

The Seller must be authorised to sell the ticket.

By publishing a listing on the Platform or uploading their tickets, the Seller authorises Rebel Tickets to carry out manual and automatic checks to detect possible fraud. These checks may include verification against databases of events, ticketing companies and resale platforms in order to confirm the validity of the ticket, its authenticity and that it has not been used previously. Although Rebel Tickets does not carry out these verifications in every case, it reserves the right to do so at any time.

In addition, the Seller must hold the receipt or proof of purchase of the ticket and, if so required, must provide it to Rebel Tickets. Although this request is not made routinely, Rebel Tickets may require such proof at any time to guarantee the security of the transaction.

All sales made on the Platform are automatic. Once a Buyer acquires the ticket, the transaction shall be deemed completed immediately, with no possibility of cancellation by the Seller. As long as their offer of sale has not been accepted, the Seller may withdraw it at any time. For the avoidance of doubt: at the moment the buyer reserves the ticket for purchase, the Seller shall be obliged to sell the ticket to the Buyer.

Description of the e-ticket:

The Seller is obliged to provide, accurately, completely and truthfully, all the required data about the ticket offered on the Platform. The Seller must include, as a minimum, the name of the event, the corresponding price and the data necessary for the management of the payment in the fields provided. Where the ticket is subject to specific conditions other than the usual ones (such as time, age, category or type-of-access restrictions), such conditions must be clearly indicated during the publication process. If the ticket entitles the holder to occupy a specific seat or to access a specific area within the venue, this information must be expressly reflected in the field provided for that purpose or, failing that, within the description of the listing.

The seller must always indicate the original price of the ticket in the corresponding field during the listing creation process. The original price is the price at which the organisation sells the ticket on its official website. If the original price has been indicated incorrectly, Rebel Tickets reserves the right to cancel the sale or to modify the price and payment of the ticket (if it has already been sold) so that it complies with the price limit (in relation to that original price) specific to the event set by Rebel Tickets or by the event organisation.

Rebel Tickets may review and, where appropriate, adjust the data associated with a published ticket where there are discrepancies between the information provided by the Seller and that appearing in the ticket document itself or in the details communicated by the event organiser.

The seller shall never include contact or personal information in the listing (including but not limited to: email address, telephone number, social media usernames...); if they do so, Rebel Tickets reserves the right to block access to their account temporarily or permanently and to remove the listing from the platform.

The bank account or IBAN that the seller indicates in order to receive payment must be located in a member state of the European Union. Otherwise, intermediary banking institutions may apply fees for the transaction, and these will be automatically deducted from the amount to be received by the seller. Rebel Tickets will not bear these fees at any time.

In any case, the seller must enter the full first name and surnames of the holder of the IBAN into which the amount will be received. Due to banking requirements, and for security reasons, the first name and surnames must match exactly those of the IBAN and those on their official identity document. The Seller is responsible for reviewing and verifying that both their name and their IBAN are correct and meet these requirements.

Incomplete names, nicknames, spelling errors or names different from the one registered as the holder of the IBAN will be rejected when the payment is made, and the seller must send the correct information. The seller shall have five (5) months to send the correct information. Otherwise, such amounts shall become the property of Rebel Tickets and shall not be refundable under any circumstances.

The Seller must be the holder of the account into which the payment is received, or be a person authorised to use that account to receive the payment.

Cost and price:

The Seller shall be responsible for setting the sale price of each ticket they publish on the Platform. This price shall be subject to any limits that may arise from the regulations in force in the jurisdiction applicable to the event. Where appropriate, Rebel Tickets may impose specific restrictions on the maximum authorised price for certain events or locations. For each completed transaction, the Seller agrees to pay a fee of 5 % of the final sale amount, taxes included, as handling fees. That fee shall be automatically deducted by the Platform before the transfer of the corresponding amount to the Seller, who will therefore receive 95 % of the price set. For events in which this figure is higher or lower, this will be clearly broken down when the listing is created. Additionally, certain payment methods may entail supplementary charges, which will be clearly communicated to the Buyer before the transaction is confirmed.

For certain payment methods an additional charge may apply, which will appear broken down before proceeding to payment. When you use an external payment provider (for example: PayPal, Klarna...) to make a payment on the platform, you must accept its terms and conditions.

The buyer understands that, when buying tickets from other people (such as through the platform), the price may be lower than, higher than or equal to the original price of the ticket in the official shop of the event.

VAT:

The tickets offered through the Platform must have borne the corresponding Value Added Tax (VAT) at the time of their original acquisition by the Seller. Rebel Tickets will apply VAT to the fees it charges both to the Buyer (as handling or transaction fees) and to the Seller (for intermediation services) and to any other fees that may apply, in accordance with the applicable tax regulations.

Sold tickets:

Once the sale has been completed, the Seller will receive a confirmation by email or push notification. From that moment, the e-ticket shall be deemed sold and the Seller shall lose access to it, and it shall remain available only to the Buyer and Rebel Tickets. The Seller must verify in their account that the ticket is correctly shown as sold.

The Seller has the obligation to destroy any copy or duplicate of the sold ticket, without exception. Nor may the seller use the ticket at any point. Likewise, it is strictly prohibited to list the same ticket on multiple platforms or sales channels. In the event that a ticket is listed and sold simultaneously on two or more platforms or channels, the Seller shall be obliged to cancel the transaction on the other platform or sales channel and to bear any consequence arising from that breach.

All tickets sold through the Platform are subject to cancellation and regeneration by Rebel Tickets at any time, in order to guarantee the validity of the transaction and the security of the Buyer. This may apply both where Rebel Tickets has a prior agreement with the promoter at the time of the sale and where such an agreement is reached or implemented subsequently.

Seller Payout:

The Seller Payout, corresponding to the agreed Sale Price less the Handling Fees, will be transferred between two and five days after the end of the event. The exact time at which the Seller receives the Payout in their bank account will depend on the bank’s processing times, and may be delayed by a few additional days.

If Rebel Tickets were to detect or receive information about the invalidity of a ticket, the existence of fraud, misuse, unauthorised resale, error, or the cancellation or postponement of the event, the Seller Payout may be suspended until the situation has been clarified. If, in the opinion of Rebel Tickets, there are justified grounds for doing so, it may cancel the Payout definitively.

In the event that the Payout has already been made and it is subsequently detected that the ticket was invalid, fraudulent or erroneous, or that the event was cancelled or postponed, Rebel Tickets may recover that amount from the Seller using the available collection methods. For these purposes, the Seller expressly authorises Rebel Tickets to make that charge to their bank account or other linked payment methods, regardless of the payment provider used in the transaction.

Cancellation of the sale:

Rebel Tickets has an interest in the proper performance of the sale agreement between the Buyer and the Seller. Accordingly, the Purchase Agreement includes an irrevocable third-party clause for the benefit of Rebel Tickets, which allows Rebel Tickets to require performance of the Purchase Agreement, to dissolve the Purchase Agreement or to annul it in the event that the Buyer or the Seller fails to comply with the conditions of the Ticket Agreement. Under no circumstances shall the cancellation of a sale release the seller from liability for any actions they may have committed.

Minimum listing price:

The default minimum price for listing a ticket on the Platform is €5.00.

However, due to requirements of Rebel Tickets or of the event organiser, this minimum limit may vary (being higher, lower or proportional to the original price). If a user publishes a listing with a price that breaches the applicable restriction, Rebel Tickets reserves the right to adjust the price automatically to comply with that minimum or to refuse publication of the listing.

Purchase of e-tickets:

The Buyer may acquire e-tickets through the payment methods available on the Platform. The costs associated with the transaction, including payment processing, amount to 10 % of the sale price (VAT included). The fees may vary depending on the specific ticket or event; however, the user will always have access to the final price before completing the purchase.

Once the purchase has been made, the ticket may be downloaded automatically from the Platform where the ticket has instant download. In addition, Rebel Tickets will supply the ticket after receiving confirmation of payment from Stripe. In certain cases, tickets may become available on a date closer to the event or be sent at a time other than that of the purchase, but always before the date of the event. Likewise, some tickets may come in alternative formats.

In some cases, Rebel Tickets or partner companies may establish additional service fees; these additional costs will appear broken down at the time the purchase is made.

In special cases, the event organisation or Rebel Tickets may require additional steps to be completed (for example: completing or verifying attendee details) after the time of purchase in order to be able to download the tickets.

The user will be able to view their tickets:

i) in My purchases in their Rebel Tickets account and

ii) by email, in the form of a download link.

Once the Buyer completes the purchase through the Platform, the transaction is considered final and legally binding. Neither the Seller nor the Buyer may unilaterally cancel the transaction. Nor will there be a withdrawal period for the Buyer or for the Seller, due to the nature of the product. On occasion, the ticket may not be delivered at the time of payment and may be delivered by email later, but always before the event.

In certain situations, tickets, reservations, passes or season tickets purchased through Rebel Tickets may include the name of the seller or of the previous owner of the ticket. Rebel Tickets does not guarantee the possibility of making changes of name or ownership on tickets purchased through the platform, except where the Platform expressly indicates this for the specific event before the time of purchase, in which case the Entry Guarantee described below shall apply. In any case, any cost of change of ownership, if any, must be paid by the buyer.

Entry guarantee with name change:

Where the Platform expressly indicates, before the time of purchase and for the specific event, that the tickets include a name change, Rebel Tickets will manage that change with the event organiser, so that the ticket is issued again in the name of the attendee indicated by the Buyer. If the name change cannot be completed before the start of the event, Rebel Tickets will cancel the purchase and refund the Buyer the full amount paid.

Once the ticket has been issued in the name of the attendee, access to the event shall be subject to the conditions of the organiser and the venue, in accordance with the section “Access to the event”. This guarantee does not apply to events for which the Platform has not expressly indicated it before the purchase.

Access to the event:

Access to any event shall be governed exclusively by the conditions established by its organiser and, where applicable, by the operator of the venue where it is held. Both the Buyer and the Seller assume responsibility for informing themselves of and complying with those conditions, without Rebel Tickets having any involvement in or responsibility for their content or application.

Event changes:

The Buyer is responsible for keeping informed about the event for which they have acquired a ticket, including possible modifications such as postponements, cancellations or other changes (hereinafter, a “Change”). The Buyer must check independently whether any alteration to the event has occurred.

For their part, the Seller must stay alert to any news relating to the event for which they have put tickets up for sale on the Platform. In the event of cancellation, the Seller shall be obliged to withdraw the listing within a maximum period of 48 hours after the official announcement by the organiser. If the ticket has already been sold, the Seller must refund the corresponding amount to the Buyer.

Although Rebel Tickets will try to contact Buyers if Changes to events occur, it assumes no obligation to do so, nor shall it be liable for any harm that such Changes may cause to Buyers or Sellers.

In the event of cancellation, the event organiser may offer Compensation to the person (natural or legal) who acquired the tickets directly through official channels. The intention is that such Compensation be transferred to the Buyer, since the Buyer becomes the legitimate holder of the ticket upon purchasing it through the Platform.

The amount of the Compensation granted by the organiser may not match the price paid by the Buyer on Rebel Tickets. This Price Difference shall not be the responsibility of Rebel Tickets, either towards the Buyer or towards the Seller. Despite this, the seller shall always have the obligation to refund the full amount they received at the time as payment for the ticket.

In principle, when an event is cancelled, Rebel Tickets will do everything possible to help the Buyer receive the Compensation from the organiser. The Seller shall be obliged to handle that claim with the organiser and, once received, to transfer the Compensation in full to the Buyer. In addition, the Seller must pay the Buyer the additional amount they received for the sale of the ticket on the Platform.

In the event that the event for which the ticket was acquired undergoes changes of date, time or location, the Seller or Rebel Tickets shall not be obliged to make any refund. In such a case, the Buyer may put the ticket up for sale again on the Platform if they do not wish to or cannot attend under the new conditions.

All transfers from the Seller to the Buyer must be made through Rebel Tickets, using the payment system enabled by Rebel Tickets for each case.

In certain cases, the applicable cancellation policy may differ from that described above. However, the aim will always be for the Buyer to receive some form of Compensation. Rebel Tickets shall under no circumstances assume responsibility for any Price Differences.

The costs associated with additional services such as transfers, changes of name or ownership, physical shipments, processing fees, insurance, as well as any fee charged by the Platform or by third parties (including payment providers), shall not be refundable.

Invalid e-ticket:

The purchase and sale of tickets through the Platform is never completely free of risk, especially with regard to the validity of the tickets delivered by Sellers. Although Rebel Tickets adopts technical and operational measures to foster a secure environment, it cannot absolutely guarantee the authenticity or functionality of all tickets marketed by Users.

In the event that a ticket is not valid for access to the corresponding event, both the Buyer and the Seller assume responsibility for resolving the situation in accordance with the provisions of this agreement. The Seller may not reuse a ticket they have sold, and the Buyer may only resell the ticket through the same account from which they acquired it. External resale outside the Platform is expressly prohibited.

When an incident of this type is reported, Rebel Tickets may intervene as a neutral party to manage the case. Initially, the Platform may contact the Buyer and the Seller individually in order to gather relevant information separately. If, after this initial analysis, no clear conclusion is reached, Rebel Tickets may set up a moderated conversation between both parties, in which the situation will be assessed jointly. On the basis of the information gathered, the Platform may determine, if it considers it justified, that the amount of the transaction be refunded to the Buyer. The active participation and cooperation of both parties in this procedure is mandatory.

In the event that the Seller does not cooperate in the resolution of an incident relating to an invalid ticket, Rebel Tickets reserves the right to refer the situation to the competent authorities, to provide the Buyer with the Seller’s identification details if they request them for legal purposes, and to limit, suspend or definitively cancel the Seller’s access to the Platform. Any case relating to allegedly invalid tickets must be reported to Rebel Tickets through the channels provided for that purpose.

Deadline for reporting problems after the event. The Buyer must report any problem with their ticket to Rebel Tickets as soon as possible through the support channels available on the Platform and, if refused entry to the event, on the day of the event.

The maximum period for reporting a possible invalidity of the ticket or any other problem depends on the Buyer's country of habitual residence:

Buyer's country of residenceMaximum period
Spain5 working days
Portugal and Belgium7 calendar days
France, Italy, Germany, the Netherlands and Ireland72 hours
United Kingdom and all other countries7 calendar days or 5 working days, whichever ends later

The Buyer's country of habitual residence shall be the one stated in their account or, failing that, the country of the payment method used for the purchase.

How the period is counted. All periods are counted from the very time at which the event ends, in the local time of the place where it is held, and not from the start of the day of the event or from the time of purchase. For events lasting several days, they are counted from the end time of the last day.

  • Periods in hours and in calendar days: they expire once the number of hours or full days has elapsed from the end time of the event. For example, if the event ends on a Saturday at 23:30, the 72-hour period expires on the following Tuesday at 23:30 and the 7-calendar-day period on the following Saturday at 23:30.
  • Periods in working days: the day of the event itself counts as the first working day if it is a working day, and the period expires at the same time the event ended on the last working day of the period. For example, if the event ends on a Wednesday at 23:30, the 5-working-day period expires on the following Tuesday at 23:30; if it ends on a Saturday at 23:30, it expires on the following Friday at 23:30.
  • Working days are Monday to Friday, excluding national public holidays in the Buyer's country of habitual residence. If a period expires on a Saturday, Sunday or national public holiday, it is extended to the same time on the next working day.

Once the applicable period has expired, no refunds can be issued under any circumstances, as the amount will already have been paid to the Seller.

When reporting the invalidity of a ticket or any kind of incident with it, the Buyer declares that they understand that submitting fraudulent or false claims, or claims containing false information, constitutes the commission of an offence of fraud, and that they may be subject to legal action for this by both the Platform and the Seller.

The Seller, when responding to a claim made by the Buyer or the platform, also declares that they understand that providing fraudulent or false information constitutes the commission of an offence of fraud and/or swindling, and that they may be subject to legal action for this by both the Platform and the Buyer.

In situations where repeated irregularities or invalid tickets are detected, Rebel Tickets reserves the possibility of limiting the use of the account involved or suspending operations, always within reasonable margins for the protection of other Users and of the operation of the Platform.

In the event that a seller markets a ticket that, for any reason, turns out not to be valid for access to the corresponding event, Rebel Tickets may (at its sole discretion and without prior notice) cancel all active or completed transactions associated with that seller, regardless of whether or not they are affected by the irregularity detected. It may also suspend or definitively delete their account, withhold or cancel any amount pending payment, and take the legal measures it considers necessary to protect the interests of buyers and guarantee the integrity of the Platform.

The Seller shall assume full liability for any damage, claim, penalty or harm arising from such conduct, expressly releasing Rebel Tickets from any liability related to these events.

In the event that the Buyer makes use of the e-ticket acquired through the Platform and accesses the event, they shall be deemed to fully accept its validity. Consequently, they shall lose any right to request a full or partial refund, as well as to submit claims of any kind against the Platform, arising from possible differences between the ticket received and the information published in the listing, including (without limitation) variations in the category, type of ticket, location, access restrictions, time restrictions, items or merchandise included with the ticket or benefits associated with the ticket.

Refund Conditions:

Where a refund to the Buyer is due, the Seller shall be obliged to make it in accordance with the conditions determined by Rebel Tickets. The situations that may give rise to a refund include, among others, the delivery of an invalid ticket, the cancellation of the event, or the delivery of a ticket in a defective, illegible or unsuitable format that has not been remedied within the period required by Rebel Tickets.

In cases where the refund is due to a cause attributable to the Seller, the Seller must pay Rebel Tickets all the fees previously paid by the Buyer, together with the costs arising from the transaction. If the seller has another sale or other sales made, Rebel Tickets will deduct this amount from the payouts to be issued to the seller.

If, at the time the need for the refund is determined, the payout to the Seller has not yet been made, Rebel Tickets may cancel that payout unilaterally, thereby avoiding subsequent repayment by the Seller. In the event that the payout has already been processed, the Seller must return the corresponding amount using the mechanisms indicated by Rebel Tickets.

In the event of non-compliance, Rebel Tickets may initiate a procedure to recover the amount, including engaging debt collection services, the costs of which shall be borne in full by the Seller.

Rebel Tickets will act as an intermediary in the refund process, using exclusively the payment methods it has enabled. Any external arrangement between Buyer and Seller that is not managed through the Platform shall be considered unrelated to Rebel Tickets and shall be carried out under the sole responsibility of the parties, without the seller being released from their responsibilities towards Rebel Tickets or the Buyer.

Refund Conditions - Cancellations:

Where the Seller is obliged to refund the Buyer due to the cancellation of an event, the Seller must make the corresponding transfer within a maximum period of 14 days after having received the compensation from the organiser. This refund shall not grant the Buyer any additional rights.

If the payout to the Seller has not yet been made at the time the refund is confirmed, Rebel Tickets may unilaterally cancel that payout, so that the Seller does not have to return the amount subsequently. In the event that the payout has already been made, the Seller must refund the amount using the methods indicated by Rebel Tickets.

In the event of failure to comply within the 14-day period, Rebel Tickets reserves the right to assist the Buyer in recovering the amount through a collection agency, with all costs arising from this process being the sole responsibility of the Seller.

Risks:

Buying an e-ticket through the Platform entails certain risks. Although Rebel Tickets works to ensure that all sales made are secure and correct, it cannot guarantee that a ticket acquired on the Platform will always be valid or that it will guarantee access to the corresponding event.

Liability:

Rebel Tickets shall not be liable for any damage, including indirect damage, that you may suffer as a result of the use of the Platform or its services, unless such damage is caused intentionally, through gross negligence or through deliberately reckless conduct on the part of Rebel Tickets. Although Rebel Tickets takes all necessary precautions to ensure the secure purchase of e-tickets, it cannot guarantee at all times the accuracy of the service or of the content offered on the Platform.

Rebel Tickets accepts no responsibility for the consequences arising from possible inaccuracies relating to the Platform, the service or the e-tickets. Likewise, Rebel Tickets reserves the right to suspend, temporarily limit or withdraw the service without prior notice and without this giving rise to any right to compensation.

Dispute:

Buyers who have entered into the Ticket Agreement must follow the claims procedures offered by Rebel Tickets (in writing or by email) if they wish to receive a refund, have an incident, or disagree with a charge made by Rebel Tickets, without prejudice to those claims methods established by law for the resolution of claims against merchants.

If the buyer were to file a dispute or chargeback through the payment method, payment facilitator or card issuer, or were to withdraw in any way the amount paid for the purchased ticket, Rebel Tickets reserves the right to collect this amount by other means, with all costs arising from this process being borne by the buyer, together with the costs generated by the dispute (such as fees established by the payment provider, Stripe, PayPal, Visa, Klarna, Revolut, Mastercard, American Express, Discover or the issuer of the card or payment method), if any.

To this end, Rebel Tickets will issue an invoice for the total amount of the costs and will send it to the email address associated with the user in question. If the established amount is not paid within 14 calendar days of the issue of the invoice, Rebel Tickets may resort to a debt collection agency to collect it, with the buyer bearing the costs of this action, Rebel Tickets also reserving the right to take legal action to claim this debt.

Identity verification (KYC):

Rebel Tickets may require at any time, and before allowing the publication of tickets or the issuing of payments, the verification of the Seller’s identity by means of an enhanced authentication procedure (“Know Your Customer” or KYC).

This verification may include a request for:

  1. Valid official identity documents (DNI, passport, residence permit, etc.).
  2. Recent proof of address (utility bill, bank statement, certificate of registration on the municipal register or other equivalents).
  3. Any other data, document or information that is reasonably necessary to validate the identity and legitimacy of the Seller.

Rebel Tickets may carry out this process directly or through external providers specialising in digital identification and verification services. The data collected during this procedure will be processed in accordance with the regulations in force on the protection of personal data and used exclusively for purposes related to fraud prevention and regulatory compliance.

The entities designated by Rebel Tickets to process payouts to the Seller may verify the information provided by checking it against their own records and against public databases, in order to detect possible irregular or suspicious activity.

As a result of such checks, the Seller may be required to provide additional documentation evidencing their identity. Official and original documentation, without any kind of modification, must always be provided.

Once the verification process has been completed, the documents provided will be deleted by the entities responsible for that management, with only the information required by Law being stored.

In the event that the Seller does not satisfactorily complete the verification process or provide the additional documentation requested within a maximum period of three (3) months from the date on which it was requested, the funds remaining in their account may be allocated to cover the administrative and operating costs arising from regulatory compliance. In such a case, those amounts shall become the property of Rebel Tickets and shall not be refundable under any circumstances. The Seller expressly acknowledges and accepts that this measure is a direct consequence of the failure to comply with the identity verification (KYC) obligations, and also declares that they have been duly informed of this policy.
